In the article, David reflects on 44 years of Canada’s Charter of Rights and Freedoms and the new challenges it faces in the age of artificial intelligence. He examines both the promise AI holds for improving access to justice and the serious risks it poses: from deepfake evidence undermining courtroom integrity to algorithmic bias in risk assessment and sentencing, and argues that transparency and accountability are essential to ensure AI strengthens, rather than erodes Charter values.
