The following is a summary of the first case conference regarding the Mefloquine Mass Tort.

On August 13, 2019, the parties attended the first Case Management Conference before Prothonotary Furlanetto of the Federal Court.

The purpose of this attendance was to introduce the cases to the Court and to work out scheduling next steps with the Government of Canada Lawyers (DOJ).

We advised the court that we have been contacted by over 2000 people, that we had been retained by 646 people. On August 14, 2019, we filed 3 more claims for an additional 187 Plaintiffs.

In addition, we pushed DOJ to provide us with their Statement of Defense so that we could focus on narrowing the issues.

Prothonotary Furlanetto was very pleasant, and agreed with this position. However, no formal Order was made on this matter.

In the interim, we will be providing DOJ with the names of all clients who are not in active service, and that have retained us, on a without prejudice basis, so that we can push them to produce their Statement of Defence by mid-September.

We will be continuing to pressure the government’s lawyers to outline their defenses so that we can move ahead with scheduling any potential “test trials”.

We anticipate being in front of the Court again in September, this time in person, and will advise of this attendance once it is scheduled.

We continue to push for remaining clients to return their retainer documentation so that our numbers can grow.

It is absolutely imperative that if you have received an intake form, please complete it and return to our office so we can get you the contract. If you are having trouble with the questions, please reach out to us and we will provide the necessary assistance.

If you have a contract and have not sent it back, please do so as quickly as possible. If you have any questions, please contact us so we can provide answers to you as quickly as possible.

At some point in the future, the court will ask us to finalize our list of Plaintiffs. Please get us your documentation as soon as possible.
