Canada-wide Class Action Litigation Regarding St. Jude Defibrillator Victims

Howie, Sacks & Henry and Waddell Phillips have launched a Canada-wide class action litigation against the makers of St. Jude Defibrillator products known as the Fortify, Fortify Assura, Fortify Assura MP, Unify, Unify Assura and Unify Quadra.

Background

In October 2016, medical manufacturer St. Jude notified patients and doctors about a defect in some of their Defibrillator models caused by lithium cluster formation in the device’s battery. The defect causes a short circuit, high current drain, rapid depletion and premature failure – sometimes with very little warning.

Individuals were implanted with a defibrillator branded as Fortify, Fortify Assura, Fortify Assura MP, Unify, Unify Assura, or Unify Quadra that was manufactured between January 2010 and May 23, 2015.

Update July 27, 2017

On Tuesday, August 22, 2017, the Court will be hearing the Plaintiffs’ motion for approval of an agreement with a Third Party Funder, BenthamIMF. If approved, the agreement will result in BenthamIMF paying a portion of class counsel’s legal fees and disbursements, and it will also provide an indemnification to the Plaintiffs for any adverse costs awards. In exchange, BenthamIMF will be paid a sliding scale percentage of any recovery from the Defendants, and class counsel will be paid a smaller sliding scale percentage of any recovery.  The current contingency fee agreement between the Plaintiffs and class counsel would be replaced by this Third Party Funding Agreement.
