HSH Partner Melissa Miller was recently interviewed by CTV News Toronto about a recent Canadian Supreme Court decision that could have a significant impact on the potential for injury victims to seek compensation from municipalities.
While the case in question, Nelson (City) v. Marchi, deals with the question of municipal liability for injuries a woman suffered while climbing over a snowbank left by city workers clearing the sidewalk, the Court’s decision could open the door to a variety of personal injury lawsuits against Canadian municipalities for negligence in their operations. As Melissa explained, “a pothole that isn’t filled in downtown Toronto that bottoms out your car and causes you a significant injury is potentially now the subject of a lawsuit.”
