Personal injury lawyer and OTLA President Adam Wagman spoke at the Canadian Bar Association’s event, Anatomy of a Trial: Demonstrations and Debriefs.
The programme covered how trials are conducted: how to handle documents, open and close to a jury, examine and cross-examine witnesses, and much more. A stellar faculty of trial judges from the Superior Court of Justice and experienced trial advocates demonstrated these skills.
In particular, Adam Wagman spoke about cross-examination of defense doctors, including:
- Attacking the qualifications
- Highlighting the defence doctor as a “hired gun” and what is earned doing assessments
- Demonstrating why the treating doctor’s opinion should be preferred
- Obtaining agreement on key issues
