What’s involved in a medical malpractice claim?

It all starts with a very thorough investigation by us, of the medical care. We get copies of all the relevant medical records from your doctors and from any hospitals that were involved in your care.

Once we have all the records, we review them carefully in our office and organize them and make sure they’re complete. Then, we consult with experts – specialists in various areas of medicine, in the areas that we need to consider for your possible case, and we have them review all the records. We get preliminary opinions from them as to whether there may be a case of medical malpractice.

Keep in mind that for medical malpractice there are two fundamental questions that we have to address:

The first is, did the medical care fall below the standard; was there substandard care.

The second question, which is equally important, is did the substandard care cause the injury or the damage to you. There can be many situations where substandard care did not necessarily cause the injury. In other words, the injury was probably going to occur in any event, even if there had been proper care.

Once we file a law suit on your behalf, then there are many other steps.
