Tait et al. v. Syed [2006] O.J. No. 4479, 2006 CarswellOnt 6956

On May 15, 2006, Howard R. Blitstein commenced a 2 week medical malpractice trial in St. Catharines on behalf of the plaintiffs, Mr. and Mrs. Tait,  and their 9 year old daughter.

In 1998, the plaintiff A.T. underwent a minor surgical procedure and the Greater Niagara General Hospital.  Prior to the procedure commencing, a spinal anesthetic was given by the defendant, Dr. Syed.  Unfortunately, Dr. Syed was negligent in both his decision to perform a spinal anesthetic and his method of doing so.

The plaintiff A.T. was left with permanent neurological deficits, including bladder and bowel incontinence and impotence.

Justice L.M. Walters released her Judgment on November 6, 2006, awarding the plaintiffs $500,000.00 in damages and pre-judgment interest.
